Acceptance of Terms

By accessing or using the HoleOut Challenge website (holeoutchallenge.com) or participating in the HoleOut Challenge at any partner driving range, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our website or services.

Description of Service

HoleOut Challenge LLC ("HoleOut Challenge," "we," "us," or "our") operates a hole-in-one challenge experience at partnering driving ranges. We install challenge equipment, tap-to-pay stations, and HD camera systems at partner ranges. Participants pay $2 per ball to attempt the challenge. Participants who successfully complete the challenge may be eligible for a cash prize of up to $10,000, subject to verification and the terms outlined below.

Eligibility

To participate in the HoleOut Challenge, you must:

  • Be at least 18 years of age
  • Be physically present at a participating partner driving range
  • Pay the posted fee ($2 per ball) via the tap-to-pay station
  • Agree to be recorded by the HD camera system during your attempt

Challenge Rules

  • Each paid ball constitutes one attempt at the challenge.
  • The ball must enter the designated target hole on the range to qualify as a successful attempt.
  • All shots are recorded by HD cameras installed at the challenge station.
  • A successful shot must be clearly captured and verifiable on camera footage to be eligible for a prize.
  • HoleOut Challenge reserves the sole right to determine whether a shot qualifies as successful based on video review.
  • Any attempt to tamper with equipment, manipulate footage, or otherwise commit fraud will result in disqualification and may be reported to law enforcement.

Prizes

  • Cash prizes of up to $10,000 may be awarded for verified successful shots.
  • The specific prize amount is determined by HoleOut Challenge and may vary by location or promotion. The posted prize amount at each participating range applies.
  • All prizes are subject to verification of the shot via HD camera footage by the HoleOut Challenge team.
  • Prize claims must be submitted through the prize claim form on our website or as directed at the partner range.
  • HoleOut Challenge will review claims within 48 hours of submission. Verified prizes will be paid out promptly.
  • Winners may be required to provide valid government-issued identification and complete tax documentation (e.g., IRS Form W-9) prior to receiving prize payment.
  • Winners are solely responsible for any applicable taxes on prize winnings.
  • HoleOut Challenge reserves the right to use the winner's first name, general location, and video footage of the winning shot for promotional purposes unless the winner opts out in writing.

Payment

Payment of $2 per ball is processed at the tap-to-pay station installed at the challenge bay. All payments are final and non-refundable. By making a payment, you acknowledge that you are paying for the opportunity to attempt the challenge and that payment does not guarantee any outcome.

Video Recording and Consent

By participating in the HoleOut Challenge, you consent to being recorded by the HD camera system installed at the challenge station. This footage is used for shot verification and may be used for promotional or marketing purposes. If you do not wish to be recorded, please do not participate in the challenge.

Partner Driving Ranges

HoleOut Challenge partners with independently owned and operated driving ranges. While we install and maintain our challenge equipment at these locations, we are not responsible for the operations, safety, or conduct of the partner range itself. Participants use the driving range facilities at their own risk and are subject to the range's own rules and policies.

Limitation of Liability

To the fullest extent permitted by law, HoleOut Challenge LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, participation in the challenge, or any related activities. Our total liability for any claim arising from the challenge shall not exceed the amount you paid to participate.

Participation in the HoleOut Challenge involves physical activity at a driving range. You assume all risks associated with using driving range facilities, including but not limited to the risk of injury from golf balls, clubs, or range equipment.

Indemnification

You agree to indemnify and hold harmless HoleOut Challenge LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from your participation in the challenge, your use of our website, or your violation of these Terms.

Intellectual Property

All content on the HoleOut Challenge website, including text, graphics, logos, images, and software, is the property of HoleOut Challenge LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on our website without our prior written consent.

Website Use

You agree not to:

  • Use our website for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or data
  • Submit false or misleading information through our forms
  • Interfere with the proper functioning of our website

Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our website or participation in the challenge after changes are posted constitutes your acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved in the courts located in Harris County, Texas.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
